Notice of Compliance
In accordance with the requirements of the Americans with Disabilities Act (ADA) of 1990, the city of Toledo does not discriminate on the basis of disability in the admission, access, or operations of its programs, services, activities or facilities. In accordance with Title II of the (ADA), when viewed in their entirety the city of Toledo’s government programs, services, activities and facilities are readily accessible to and usable by qualified Individuals with Disabilities.
The city of Toledo does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under Title I of the Americans with Disabilities Act (ADA). The city of Toledo provides appropriate aids and services leading to effective communication for individuals with disabilities at all city sponsored functions when requested so that the individuals can participate equally in the city’s programs services, and activities. This communication is provided by qualified sign language interpreters, documents in Braille, special amplification equipment and other ways of making information and communications accessible to individuals with speech, hearing or vision impairments.
Modifications To Policies And Procedures
The city of Toledo has made reasonable modifications to its policies, practices and programs in the past and periodically reviews current policies, practices, procedures, and programs to ensure that individuals with disabilities have an equal opportunity to enjoy all city programs, services and activities.
The city of Toledo has built their website around the Standards of the World Wide Web Consortium’s (W3C) Hyper Text Markup Language (HTML) 5 and Cascading Style Sheets (CSS). The website was built in compliance with the accessibility standards established by Section 508 of the Rehabilitation Act and detailed in section 1194.22 of the Code of Federal Regulations, “Web-based intranet and internet information and applications”. If any page is discovered to be inaccessible, please report it and our web developers will work to correct it immediately.
The city of Toledo does not and will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids and services or reasonable modifications of policy.
The ADA does not require the city to take any action that would fundamentally alter the nature of its programs or services, or impose an undue financial or administrative burden.
The Office of Diversity and Inclusion has been designated to ensure the coordination of the city of Toledo’s compliance with the ADA, including the investigation of any complaint alleging Title II discrimination. The city of Toledo has an internal grievance procedure providing for prompt and equitable resolution of complaints alleging discrimination on the basis of disability in violation of the U.S. Department of Justice regulations implementing Title II of the ADA. This procedure has been developed to comply with 28 CRF 35.107(b).

The Americans with Disabilities Act (ADA) of 1990 is a civil rights statute enacted by the U.S. Congress and was signed into law on July 26, 1990, and later amended with changes effective January 1, 2009. The ADA is a wide-ranging civil rights law that prohibits discrimination against people with disabilities. There are five separate Titles (sections) of the Act relating to different aspects of potential discrimination. Title II of the Act specifically addresses the subject of making public services and public transportation accessible to those with disabilities. With the advent of the Act, designing and constructing facilities for public use that are not accessible by people with disabilities constitutes discrimination.
The city of Toledo is covered under ADA, Title I (employment) and Title II (programs, activities and services). The ADA requires the city to make all its programs, activities, and services readily accessible and useable by qualified persons with a disability when the programs, activities, and services are viewed in their entirety.
The city of Toledo has a Grievance Procedure that meets the ADA requirements. It includes a description of how and where a complaint is filed. It included a statement notifying potential complainants that alternative means of filing is available. The procedure includes time frames and processes to be followed, information on how to appeal an adverse decision, and a statement of how long a complaint file will be retained.
The city of Toledo has updated the Notice of ADA Compliance in an effort to provide more in-depth information and direction to the community. The ADA Notice is also in all city owned/leased buildings, and can be found on all posting boards in all city offices.
The ADA, the most sweeping piece of civil rights legislation, is an extensive law, which affects every aspect of life for millions of Americans by ensuing equal opportunity in the areas of employment, state and local government services, public accommodations and telecommunications.
The City of Toledo shall not discriminate on the basis of a disability with respect to recruitment, job application procedures, hiring, training, promotion, demotion, layoff, recall, employee compensation, discipline, termination and other terms, conditions, and privileges of employment provided the individual is qualified to do the work, and/or qualified to participate, with respect to a city sponsored activity, program or service.
