The Lead Safe Toledo program protects residents from exposure to lead hazards in rental housing (1-4 units).
Lead hazards can include deteriorated paint, lead dust, and contaminated soil in and around older homes. These hazards are most common in properties built before 1978.
The City requires property owners to meet lead-safe standards and obtain a Lead-Safe Certificate before renting covered units.

Tenant Rights
Under the Lead Safe Toledo ordinance and Ohio law, tenants have the right to live in safe housing and to be informed about potential lead hazards.
You have the right to:
- live in a rental unit that meets City lead safety requirements
- receive required lead safety disclosures before signing a lease
- be informed of any known lead-based paint hazards
- report unsafe housing conditions to the City
- be protected from retaliation for reporting concerns

Reporting a Problem
Lead safe work practices are required when working in homes built before 1978.
Tenants should report concerns if they notice:
- peeling or flaking paint
- dust or debris buildup in windows
- unsafe housing conditions
- missing or unclear lead safety disclosures from landlord
- contractor not complying with lead safe practices

Anti-Retaliation Protection
Tenants are protected by law when they report lead hazards or request enforcement of lead safety requirements.
A property owner, or anyone acting on their behalf may not take any retaliatory action against a tenant for:
- reporting suspected lead hazards
- requesting the property owner to hire a local lead inspector for a lead clearance exam
- contacting the City or Health Department
- reporting a failure to obtain or maintain a Lead-Safe Certificate
- cooperating with City investigations
Retaliation is any action taken to punish, pressure, or interfere with a tenant's rights. This may include:
- eviction without valid legal cause
- refusing to renew a lease
- raising rent or unfairly changing lease terms
- threats or harassment
- reducing services or access to the home
- any action that interferes with a tenant's use or enjoyment of the property
