A Lot Split or Minor Subdivision allows the division of a parcel of land up to five lots. A Major Subdivision or Plat is more than five lots.

What it allows you to do:

  • Establish new legal property boundaries
  • Create parcels for development, sale, or transfer

Example projects:

  • Split a large residential lot into multiple buildable parcels
  • Dividing land for sale to different buyers
  • Creating a new lot for an accessory building or expansion

Apply

  • Applicant must be the property owner, developer, or authorized agent
  • Prepare a survey and legal descriptions for existing and proposed lot lines
  • Complete the appropriate Lot Split application online

Fees

The Lot Split fee is $150 per proposed split. Additional fees may be necessary if your project requires resubmittals or specialized reviews.

Review Process and Timeline

Reviews are typically completed within several weeks, depending on submission completeness and project complexity.

  • Toledo-Lucas County Plan Commissions staff will review the application
  • Staff may request revisions or resubmission
  • Applications may be approved, conditionally approved, or denied. Denied applications can be appealed within 60 days.
  • Approvals are valid for two years – deed must be filed before the approval expires
    • Newly proposed lots will need to be written into new deeds with legal descriptions that match the approval
    • New deeds must be signed and notarized
    • Take new deeds to Toledo-Lucas County Plan Commissions for final approval
    • Take newly approved deeds to Lucas County Auditor and Recorder for recording

Helpful tips:

  • Verify your application and descriptions are thorough and complete
  • Check zoning compliance – lot splits cannot create nonconforming lots
  • Check for required easements and access provisions. All parcels must front on a public right-of-way.
  • If septic or well systems are proposed, approval from Lucas County Health Department is required
  • Survey must clearly show dimensions, road access, and existing features
